A taxi driver has been fined £150 after he was spotted smoking in his vehicle.
Paul Sutton, chair of the Southend Licensed Tax Drivers' Association, became the first person in Southend to be prosecuted for smoking in an enclosed public place.
A council official saw Sutton smoking at the wheel as he drove. There was nobody else in the taxi at the time.
Sutton admitted smoking but said he has now given up and uses an electronic cigarette.
Under the Smoke-free (Exemptions and Vehicles) Regulations, all parts of enclosed vehicles must be smoke-free if they are used by members of the public.
